One of the City of Kalispell attorneys, Richard (Rich) Hickel, recently wrote a letter to the Task Force overseeing the Office of State Public Defender (OPD) in Montana wherein he accuses OPD of filing “frivolous motions” and thus wasting valuable public resources. In his attack, Rich used one of my cases as an example of how OPD attorneys file frivolous motions. Rich’s letter, however, did not give an accurate description of the real problem with wasting public tax dollars. Having personal experience with the matters Rich addressed, I felt compelled to shed light on Rich’s accusation and particularly, the case Rich used to support his accusations against OPD.
